The Nigeria Customs Service (NCS) has announced the implementation of new guidelines regulating the dwelling time for import and export consignments at port terminals, aiming to enhance trade facilitation and align with the Federal Government’s Ease of Doing Business initiatives. The measures are designed to address port congestion, streamline clearance processes, and resolve disputes linked to overtime cargo disposal.
Under the Nigeria Customs Service Act (NCSA) 2023, imported consignments must be cleared within 30 days after discharge from the importing carrier or within a timeframe prescribed by the NCS, as outlined in Section 30(1). Additionally, Section 149(1) empowers the Service to set time limits for cargo to leave customs territory, ensuring compliance and minimizing delays at port terminals.
The new guidelines provide a 30-day grace period from the date of arrival for all consignments, free from overtime clearance restrictions. Cargo that exceeds 30 days will be classified as “overtime” but may still be cleared within an additional 30 days, subject to approval by the relevant Customs Area Controller (CAC). Beyond 60 days, clearance will require approval from the Assistant Comptroller-General or Zonal Coordinator and must be completed within 90 days of arrival. Consignments uncleared after 90 days will be subject to the disposal process.
The NCS emphasized that it reserves the right to initiate disposal proceedings after the initial 30-day grace period, as stipulated by the NCSA 2023. The Comptroller-General of Customs, Bashir Adewale Adeniyi, MFR, reaffirmed the Service’s commitment to transparency, efficiency, and maintaining a seamless cargo clearance process.
These guidelines are expected to alleviate port congestion, prevent legal disputes over overtime cargo, and foster smoother trade operations. Stakeholders have been urged to adhere to the new regulations to support the collective goal of efficient trade facilitation.
