Falana Chambers Warns INEC Against Recognizing Expired Leadership In Labour Party

Falana Chambers has issued a stern warning to the Independent National Electoral Commission (INEC) against recognizing Julius Abure as the Acting National Chairman of the Labour Party. The legal firm, representing the National Transition Committee of the Labour Party, asserts that Abure’s tenure has expired and further recognition would violate a

Federal High Court judgment in Suit No: FHC/ABJ/IC/866/2014 and an INEC-brokered agreement dated June 27, 2022.

In a letter dated July 4, 2024, and signed by Marahal Abub

akar, LP, Falana Chambers requested that INEC desist from associating with Abure and his associates. The firm emphasized the importance of adhering to the administration of justice and the rule of law, attaching a report of the mediated settlement and a certified true copy of the Federal High Court judgment to the letter.

The letter highlighted that the Labour Party has not conducted any elections for over four years, a situation that contravenes Section 233(1)(a) and (2)(a) of the 1999 Constitution, as amended, alongside Section 82(3) of the Electoral Act, 2022. The firm also noted that the Nigeria Labour Congress (NLC) is the platform of the Labour Party, and the party’s inability to conduct elections is due to the expired tenure of

Abure and his National Working Committee.

Falana Chambers warned that if INEC fails to comply with their request, they will initiate contempt proceedings against the INEC Chairman at the Federal High Court. The letter concluded with a clear statement: “TAKE NOTICE that unless you comply with the foregoing request forthwith, we shall approach the Federal High Court and institute contempt proceedings against you.”

The legal firm’s warning underscores the importance of adhering to legal mandates and ensuring that leadership within political parties is properly elected and recognized in accordance with the law.
